1. Introduction

Texture, Inc. ("the Company," "we," "us," or "our") operates gettexture.org (the "Service"). The Company provides AI-powered grid orchestration and distributed-energy resource (DER) management software for electric utilities and energy cooperatives. This Privacy Policy explains what information we collect through the Service, how we use it, and the choices available to you.

Texture's platform ingests grid telemetry and DER operational data (not consumer personal information) to help utility operations teams balance load and dispatch distributed energy assets. The personal information we collect is limited to operator account credentials, contact details for demo and sales inquiries, and standard web-analytics data from visitors to this marketing site.

2. Information We Collect

2.1 Information You Provide

We collect information you submit directly, including:

• Contact details (name, work email, phone) when you fill out a contact or demo-request form;
• Professional context you choose to share (employer, role, organization type such as municipal utility or cooperative);
• The content of any messages or inquiries you send us;
• Account credentials (email and password) for licensed operator accounts on the Texture platform.

2.2 Grid and DER Operational Data (Platform Customers Only)

Customers who license the Texture platform connect their existing SCADA, AMI, and battery management systems to our data-ingestion layer via standard protocols including IEEE 2030.5, DNP3, MODBUS TCP, and OpenADR. This data stream consists of grid telemetry: device state-of-charge readings, generation output, load measurements, and dispatch event records. This telemetry relates to grid infrastructure, not to individual consumers. It is processed solely to generate AI dispatch recommendations, maintain a real-time grid model, and produce audit-trail records for the customer's regulatory reporting obligations. Texture does not use grid telemetry or DER operational data to train models outside the scope of the customer's service agreement, and we do not sell or disclose it to third parties.

2.3 Information Collected Automatically

When you visit gettexture.org, we automatically collect limited technical information:

• IP address and approximate location (city/region level);
• Browser type, operating system, device class;
• Pages visited, referring URLs, time on page;
• Cookie and similar identifiers (see Section 5 and our Cookie Policy).

2.4 We Do Not Knowingly Collect Children's Data

gettexture.org is a business-to-business service directed at utility professionals. We do not knowingly collect personal information from anyone under 13. If you believe a child has provided us information, contact [email protected] and we will delete it.

3. How We Use Information

We use the information we collect to:

• Respond to demo requests, sales inquiries, and support questions from utility and grid operations professionals;
• Provision and operate licensed Texture platform accounts for utility customers;
• Generate AI dispatch recommendations and maintain the real-time grid model for platform customers, using only that customer's own grid telemetry;
• Produce audit-trail records and regulatory reporting exports for platform customers' compliance needs;
• Operate, maintain, and improve the marketing site (gettexture.org) and the Texture platform;
• Send service updates and (with your consent where required) communications about the Texture platform;
• Detect, investigate, and prevent fraud or abuse;
• Comply with legal obligations.

We do not sell personal information for monetary value. Where applicable state law treats certain advertising arrangements as a "sale" or "share," see your state's section below.

4. Sharing of Information

We share personal information only with:

• Service providers acting on our behalf (such as cloud hosting, email delivery, and analytics) under contractual confidentiality terms that limit their use to providing the relevant service;
• Authorities, when required by law or court order, or to protect the rights, safety, or property of the Company or others;
• A successor entity in the event of a merger, acquisition, or asset sale, subject to this Policy.

We do not sell personal information to third parties. Because Texture is independently funded, we have no investor board or external financing party with privileged access to customer or visitor data.

6. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy, to comply with legal or accounting obligations, and to resolve disputes.

• Marketing and contact-form submissions: active for 24 months from last contact, then purged or anonymized;
• Platform customer account data: retained for the duration of the service agreement and for a period thereafter as required for audit and regulatory purposes;
• Grid telemetry and DER operational data: retained per the terms of the applicable customer agreement, typically 13 months of rolling hot storage plus archival as required for ISO settlement documentation;
• Server access logs for the marketing site: 90 days, then aggregated.

7. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption in transit, restricted-access databases, and least-privilege access controls. The Texture platform architecture is designed to keep grid telemetry isolated within each customer's environment. No system is perfectly secure; we cannot guarantee absolute security.

8. Your General Rights

Depending on your jurisdiction, you may have rights including access, correction, deletion, and the ability to limit certain processing. To make a request, email [email protected]. We will respond within the timeframe required by applicable law.

9. New York Residents

New York does not currently have a comprehensive consumer privacy statute. As a matter of policy, we extend the following baseline rights to all U.S. residents regardless of state of residence.

9.1 Baseline Rights

• Right to Know: request the categories of personal information we have collected about you.
• Right to Delete: request deletion of personal information you have provided.
• Right to Correct: request correction of inaccurate personal information.
• Right to Opt Out of Marketing: unsubscribe from marketing emails or opt out via the link in each marketing message.

9.2 How to Exercise

Email [email protected] with a description of your request and enough detail for us to verify your identity. We respond within 45 days.

9.3 Sector-Specific Rights

If you are protected by federal sector laws (such as HIPAA, GLBA, or FERPA), those laws may give you additional rights with respect to data covered by them. Utility customers bear their own obligations under applicable energy-sector regulatory frameworks, including NERC CIP and relevant state utility commission data-handling requirements; nothing in this Policy alters those independent obligations.

9.4 California Visitors

If you are a California resident, you may also exercise the rights granted under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing. We do not sell personal information and do not "share" personal information for cross-context behavioral advertising.
